ARTICLE 3 - AVAILABILITY OF GOODS

All goods are available in the Store. When a product is out of stock, the page will announce it. We will reorder it for you as soon as possible. When a product is not available anymore, it will disappear from the store. You also can write us to know when a product is available:

Preorders: Some products are on preorders. Indicated release dates are given by the supplier. If a product is late, Lulu Koala Store cannot be considered responsible. Check the product page for further information. If the releases date changes, it will be updated on the product page.

Back orders: Back order products are indicated with on the product page with date.

 

ARTICLE 4 - PRICES

Prices are given in Euro and are shown.
VTA is included.
Shipping is not included in the retail price.

Books are sold in accordance with current regulations and more particularly in accordance with current French legislation on uniform book pricing, under which the book price, excluding carriage, is determined by the publisher.

The price is due with order (total amount, one single payment).
All orders are invoiced in Euro and payable in Euro.
Please use an exchange rate online device to convert the amount in euro into your local currency.
For deliveries outside Metropolitan France, any customs duty and/or local taxes are payable by the consignee.

 

ARTICLE 5 - SHIPPINGS FEES

Shipping fees includes the cost of posting + handling and packing.
Shipping is based on weight and destination.
Add items to your basket and the store will indicate the full price.
The geographic zone and the means of dispatch selected by you are the only factors which will affect the total.
Consider batching all your goods into one single order. We cannot combine two separate orders and you will be invoiced for carriage costs on each of the orders.

This method of payment provides the maximum guarantee of security.

You can use your Paypal account or pay on Paypal with you Visa Card.

 

ARTICLE 7 - DELIVERY AND RETOUR

Whether you are ordering from France or from abroad, we deliver to your door.
The delivery time includes the time needed to prepare the package + the time to deliver it.

The delivery time is:

5 days to France for a delivery in a relay point

3 days to France for a delivery with Colissimo Access

3 day to France for a delivery with Colissimo Expert

24/48 hours to France for a delivery with Chronopost

Delivery time can change from a country to another. Usually it takes 10 to 15 days to reach foreign destination. Due to customs, delivery time can be longer.

Right of withdrawal

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail):

You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than – (a) 14 days after the day we receive back from you any goods supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or (c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

ARTICLE 8 - NO QUIBBLE GARANTEES: SATISFACTION, EXCHANGE OR REFUND

Product quality
Items supplied by Lulu Koala are brand new and guaranteed against any defect.
They are identical to items on sale in traditional retail outlets and come from the listed publishers and suppliers.
If it turns out that an item is defective or does not match its description, we undertake to refund it.

To be refunded, please send us a picture of the damaged item first at contact@lulukoala.com

Please do not send us back the product directly without having sent the picture and got our instructions.

Where a refund is required, we guarantee that it will be made by bank transfer within 15 days or less following the date the returned package is received.

No dispatch in counter-reimbursement will be accepted, for any reason whatsoever.
Where the order involved use of a coupon or gift voucher, a refund is the only option (the full amount of the coupon or voucher will be re-credited).

Quality service
If you change your mind, you have the right to return items for any reason without explanation. You can return an item to us within 15 days following receipt of your package (the item must be in its original cellophane wrapping and with the relevant invoice),

If it’s your decision to send the order back, shipping fees will be paid by you. Lulu Koala Store cannot take responsibility for that.

Please note: this guarantee does not apply to products which can be immediately copied and where the original seal is broken. For such products, your money refunded as soon as possible, on condition that the item is intact and shows no sign of having been used.

Missing product : If a product is missing, please send us a signed letter telling the story and the missing product. This letter is an attestation of honor, and your declaration should remain true.

 

ARTICLE 9 - TRANSFER OF OWNERSHIP - TRANSFER OF RISK

Ownership of the products transfers to the purchaser only after full payment of the purchase price by the latter. This applies regardless of the delivery date of the aforementioned products.
On the other hand, the risk loss and/or damage of the products transfers at the time of delivery and receipt of the aforementioned products by the Purchaser.

When you make purchases, we only ask you for information (surname, first name, address, email address) which we must have if we are to provide a high standard of order processing and monitoring.

Your rights
In accordance with French data protection legislation (the Loi Informatique et Libertés of 6 January 1978), you have the right to access and correct any data which concerns you. Through us, you may sometimes receive offers from other businesses and organisations and information about our offers by email or by post.

The books in Lulu Koala – Euroservices Partner databases have been input using information provided by the publishers. Lulu Koala – Euroservices Partner are not liable for the content of the publications and shall not be held liable in any way toward the purchaser.
The products offered meet the requirements of current French legislation. Lulu Koala accept no liability in the event that the item delivered does not meet the requirements of legislation in the country of delivery (censorship, banned titles or authors, etc.).
Lulu Koala – Euroservices Partner shall not be held liable in the event of non-performance of contract due to force majeure (strike, flood, fire, etc.).
Lulu Koala – Euroservices Partner shall not be held liable in relation to the content of any websites which can be visited via a hypertext link contained on our own website.

 

ARTICLE 12 - JURISDICTION

All the clauses contained in these general terms and conditions of sale, as well as all sale and purchase operations which are referred to in them, will be subject to French law. The Courts will be those of the jurisdiction of Strasbourg, the Courts of the headquarters of Lulu Koala – Euroservices Partner where the contract between the parties is made.

 

ARTICLE 13 - ACCEPTANCE BY THE PURCHASER

These terms and conditions of sale as well as the tariffs are expressly agreed and accepted by the Purchaser, who declares and acknowledges that they have a complete understanding of them, and who thereby waives the right to take advantage of any conflicting document and, in particular, his own general terms and conditions of purchase, the act of purchasing entailing acceptance of these general terms and conditions of sale.
These terms and conditions may be amended at any time without prior warning.

 

ARTICLE 14 - WITHDRAWAL RIGHTS
If you change your mind and want to return us an order you don’t want anymore, you have 14 days starting the day you receive the order. You’ll have to email us first your order number and the product you want to return at contact@lulukoala.com

You will get refund in the next 15 days, refunded by Credit Card or a Voucher of the amount you spent in the store.
We will not accept withdrawal form products you can copy such as DVD-ROMS.

 

ARTICLE 15 - TERMS OF USE FOR A PRODUCT OUT OF FRANCE
When you’re living outside France and you order a product from the store, you are considered as an importer. Customs can ask you for taxes, in this case, you’re responsible for any further spent.
You have to ask your local customs for further information about fees you could have to pay, and authorisations of use of particular product. We can’t be responsible for bringing illegal products in a country when you order it on purpose. Check out first before ordering.

 

ARTICLE 16 - YOUR PERSONAL INFORMATION
If you order something in Lulu Koala Online Store, we will keep your personal information. French Law tells us you have the right to ask us to erase your data. If you want to us to do so, you’ll have to write us at:
